For over 30 years, Jim has been assisting clients with obtaining and intellectual property rights in a wide variety of technologies. Jim focuses his practice on client counseling and the preparation and prosecution of patents and trademarks throughout the world, including defending granted patents against validity attacks. Jim has prosecuted over 1,500 U.S. and foreign patent applications during his legal career, and has filed applications in the U.S., Canada, Europe and several countries in Asia and South and Central America in the last 12 months.
Jim has conducted over 100 formal patent invalidity and/or non-infringement studies in the U.S. and overseas. To that end, Jim has worked closely with counsel in countries as diverse as Germany, the Netherlands, China, India, Argentina, Brazil and others to analyze validity and infringement issues outside the U.S., to help protect the rights of OspreyIP’s clients globally.
In addition to his opinion work, Jim has overseen opposition proceedings before the European Patent Office (with several currently pending). Jim has also argued before the Court of Appeals for the Federal Circuit and the Patent Trial and Appeal Board, conducted inter partes proceedings before the U.S. Trademark Trial and Appeal Board and litigated patent and trade secret disputes in a variety of U.S. District Courts and before the International Trade Commission. Jim has also overseen patent infringement litigation in France and Germany.
